By signing in to or using the Witly application, you agree to be bound by these Terms of Use. If you do not agree, please do not use the app.
2. About Witly
Witly is an AI-powered caption generation app that helps users create, curate, and randomise captions for social media posts. Witly is operated by Sudeep Bhattacharya, based in New Delhi, India.
3. Eligibility
You must be at least 18 years old to use Witly. By using the app you confirm that you are 18 or older.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must provide accurate information when registering
- You may not share your account with others
- We reserve the right to suspend or terminate accounts that violate these terms
5. Subscription Plans and Payments
Free Plan:
- 10 caption generations per day
- Access to 3 categories
- The Neutral mood only
Pro Plan (₹299/month):
- 30 caption generations per day
- All categories, all moods, caption length and photo captions
Pro Max Plan (₹599/month):
- 60 caption generations per day
- Everything in Pro, plus bulk generation and platform-specific captions
Billing:
- Daily generation limits reset at midnight, India time. One generation is one tap that creates captions
- Subscriptions are billed monthly via Razorpay
- Payments are processed in Indian Rupees (INR). No GST is charged
- Subscriptions auto-renew each month unless cancelled
- You can cancel anytime from your Profile page
- No refunds are provided for partial months, except for charges made by mistake, as set out in our Refund & Cancellation Policy
- Upgrading from Pro to Pro Max starts Pro Max immediately at the full price; your Pro plan ends and unused Pro days are not refunded
- Prices may change with 30 days advance notice
6. Acceptable Use
You agree NOT to use Witly to:
- Generate captions that are hateful, abusive, discriminatory, or harassing
- Generate content that violates any applicable laws or regulations
- Impersonate any person or entity
- Upload images that contain nudity, violence, or illegal content
- Attempt to reverse engineer, hack, or disrupt the app
- Use automated tools to access the app beyond normal usage
- Resell or commercially exploit Witly's content without permission
7. Intellectual Property
Your Content:
- You retain ownership of images you upload
- You retain ownership of captions you save
- By using Witly you grant us a limited licence to process your content solely to provide the service
Our Content:
- The Witly app, logo, design, and underlying technology are owned by us
- You may not copy, modify, or distribute our app or content without permission
Generated Captions:
- Captions generated by Witly's AI are provided for your personal and commercial social media use
- We do not claim ownership of captions you generate
8. Disclaimer of Warranties
Witly generates captions using artificial intelligence. AI-generated captions may occasionally be inaccurate, inappropriate, or resemble existing content. You are responsible for reviewing any caption before you post or publish it. Witly is not responsible for how you use the captions you generate.
Witly is provided "as is" without warranties of any kind. We do not guarantee:
- That the app will be available at all times
- That generated captions will be error-free or suitable for your specific needs
- That the app will meet all your requirements
9. Limitation of Liability
To the maximum extent permitted by law, Witly and its operators shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of data or profits arising from use of the app
- Any content generated by the AI that you choose to publish
10. Termination
We reserve the right to suspend or terminate your access to Witly at any time if you violate these Terms of Use. Upon termination, your right to use the app ceases immediately.
11. Governing Law
These Terms of Use are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
12. Changes to Terms
We may update these Terms of Use from time to time. We will notify you of significant changes via email or in-app notification. Continued use of Witly after changes constitutes acceptance of the updated terms.
